Question by ladysweetiebabej: What shall we do (sue the vet) can we?
we took our dog to the vet he hadn’t been eating or drinking, he was very weak, and could barely walk, also kept being sick on the way there. The vet looked at his very bloodshot eyes but ignored it, she then took his temperature and said it was high but not serious. She then said “stop wasting my time i have better things to do, i have been pulled away from more sick animals than this” she then told us to make an appointment for the next day so we made 1 there and then. She then sent us away and told us not to come back until our appointment she said we had wasted enough of her time. We made it home but on the way there i could see that my poor little thing was getting more ill by the 2nd, i then took him straight back down which is about a 30 minute bus ride, we got down there and there was another vet on duty, she saw us straight away and as soon as we entered the room he was sick! she immediatly took his tempreture and saw that it was 106 degrees, and then diagnosed him with parvovirus she then put him on a drip and cared for him and sent us home and told us he had a 50/50 chance of survival, and said if he gets any worse we will give you a call. That night we had a phone call from a new vet on duty who then asked us to come in because he didn’t think that he would last through the night, we then got there whithin 10 mins of having this phone call. We went in to see our little angel he was so weak and couldn’t even blink, the vet said ” Its very unlikely that prince will last the night and it would be cruel to keep him alive as he’s in alot of pain” we then said our goodbyes and had the dreadful words “hes gone” it broke my heart to hear him say that. I then asked him ” if i had brang him in yesterday would he have had more chance of surviving?” the vet then replied ” yes he may have because yesterday there may have been more we could have done” we want to sue the 1st vet who completely ignored the fact he was seriously ill. we miss him so much and would like to give other animals the chance of living, so i want her sacked. we’ve lost the best thing in our lives and i want justice, and peace of mind that she isnt going to neglect other animals that might also have a chance.

It is all about the proof. The vet has to be 100% sure that if something would have been done sooner, the dog would have survived.

The vet said ” may have survived, because there may have been more we could have done. That is not saying he would have survived if treated sooner. Write a letter to the vet clinic explaining the events but other than that not much you can do. Sorry for the loss of your pet.
I would love to hear the vet’s side of this. I have a hard time believing that she said “stop wasting my time i have better things to do, i have been pulled away from more sick animals than this” and “we had wasted enough of her time”. I’m sorry about your pet. But sometimes they just can’t get better.
You don’t have any cause of action against the vet. You cannot prove that she was the cause of your dog’s death, and you had the option of taking the dog to another veterinary clinic for a second opinion. Dogs are not humans and do not have the same type of medical protections a person has. Where a human is entitled to receive emergency health care, there is no such requirement for dogs. A vet is absolutely allowed to refuse to provide care. They cannot be forced to take care of your pet.
Also, if you bring a lawsuit, your behavior, conduct and history would become very relevant. My sense from reading your scenario is that the vet probably has a very different account of what happened. I also took a look at the questions you have asked in the past . . . and I don’t mean to be offensive, but it looks as though you have a number of issues that would make it difficult for a judge to find you credible.
